TERMS OF SERVICE

1. Acceptance of Terms

By downloading, installing, or using CloudOps ("the Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

These Terms constitute a legal agreement between you and Llaps Digital ("we," "us," or "our") regarding your use of CloudOps.

2. Service Description

CloudOps is a macOS desktop application designed for iOS and macOS developers to manage their CloudKit containers. The Application provides:

• Data Import & Upload: Import JSON, CSV, and Excel files to CloudKit

• Data Browser: View, edit, and delete CloudKit records

• Schema Visualization: View your database structure as ER diagrams

• Schema Editor: Create and modify record types visually

• Backup & Restore: Create local backups of your CloudKit data

• Zone Management: Create and manage CloudKit zones

• Query Builder: Build advanced queries with filters and sorting

• Subscription Viewer: Monitor push notification subscriptions

• Incremental Sync: Track changes in your containers

The Application operates entirely on your local device and communicates directly with Apple's CloudKit servers using your credentials.

3. Purchase & Payment

One-Time Purchase

CloudOps is available as a one-time purchase through the Mac App Store. Pricing is displayed on the App Store and may vary by region.

Payment Processing

• All payments are processed by the Apple App Store

• We do not have access to your payment information

• All purchases are subject to Apple's terms and conditions

• Refund requests must be directed to Apple

Updates

Your purchase includes:

• All future updates to the current major version

• Bug fixes and security patches

• New features added to the Application

4. System Requirements

To use CloudOps, you need:

• macOS 14.0 (Sonoma) or later

• An Apple Developer account with active membership

• CloudKit containers configured in your developer account

• CloudKit credentials (Server-to-Server keys or API Token)

You are responsible for ensuring your system meets these requirements.

5. Your Data & Credentials

Credential Ownership

• You own and control your CloudKit credentials

• You are responsible for keeping your credentials secure

• We cannot access, recover, or reset your credentials

• We are not responsible for unauthorized access due to credential compromise

CloudKit Data Ownership

• You retain full ownership of all CloudKit data you manage through the Application

• The Application is a tool; your data belongs to you and your CloudKit containers

• We have no access to your CloudKit data

Local Backups

• Backup files you create are stored locally on your device

• You are responsible for securing and managing backup files

• Backup files may contain sensitive CloudKit data

Credential Storage

• Your credentials are stored in macOS Keychain

• The Application does not transmit credentials to Llaps Digital servers

• Credentials are only used to authenticate with Apple's CloudKit API

6. Acceptable Use

You agree to use CloudOps only for lawful purposes. You must NOT:

• Use the Application to violate any laws or regulations

• Attempt to circumvent Apple's CloudKit terms of service

• Use the Application to access containers you don't have permission to access

• Attempt to reverse engineer, decompile, or disassemble the Application

• Redistribute, resell, or sublicense the Application

• Remove or alter any proprietary notices or labels

• Use the Application to disrupt or damage CloudKit services

• Share your Application license with unauthorized users

Developer Responsibility

As a developer using CloudKit, you are responsible for:

• Complying with Apple's CloudKit terms of service

• Properly managing your development and production databases

• Ensuring your use complies with applicable privacy regulations

• Backing up important data before performing bulk operations

7. Intellectual Property

Application Ownership

CloudOps, including all code, design, graphics, documentation, and associated materials, is owned by Llaps Digital and protected by intellectual property laws.

License Grant

We grant you a limited, non-exclusive, non-transferable license to:

• Install and use the Application on devices you own or control

• Use the Application in accordance with these Terms

Restrictions

This license does NOT include the right to:

• Modify, adapt, or create derivative works

• Distribute, license, or sell the Application

• Use Llaps Digital trademarks without permission

8. Third-Party Services

Apple CloudKit

The Application connects to Apple's CloudKit Web Services. Your use of CloudKit is governed by:

• Apple Developer Program License Agreement

• Apple's CloudKit terms of service

• Apple's Privacy Policy

We are not responsible for Apple's services, their availability, or changes to their APIs.

Mac App Store

Distribution and payment is handled by the Mac App Store, subject to Apple's terms.

No Other Third Parties

The Application does not integrate with any other third-party services. We do not use analytics, crash reporting, or advertising services.

9. Warranty Disclaimer

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability

• Fitness for a particular purpose

• Non-infringement

• Accuracy or reliability of results

• Uninterrupted or error-free operation

CloudKit Dependency

The Application depends on Apple's CloudKit services. We do not warrant that:

• CloudKit will be available at all times

• CloudKit API will remain unchanged

• Data operations will always succeed

• CloudKit will be compatible with future macOS versions

Data Operations

You acknowledge that:

• Bulk data operations carry inherent risks

• We recommend backing up data before major operations

• We are not responsible for data loss resulting from Application use

• Production database operations should be performed with caution

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

LLAPS DIGITAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or data corruption

• Loss of profits or revenue

• Business interruption

• Cost of substitute services

• Any damages arising from use or inability to use the Application

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION.

Acknowledgment

You acknowledge that:

• The Application is a developer tool with significant capabilities

• Improper use can result in data modification or deletion

• You are responsible for understanding operations before executing them

• You should maintain backups of important CloudKit data

11. Indemnification

You agree to indemnify, defend, and hold harmless Llaps Digital and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Application

• Your violation of these Terms

• Your violation of any third-party rights

• Your CloudKit data or how you manage it

12. Termination

Your Right to Terminate

You may stop using the Application at any time by:

• Uninstalling the Application

• Deleting your credentials from Keychain

Our Right to Terminate

We may terminate or suspend your access if you:

• Violate these Terms

• Engage in fraudulent or illegal activity

• Abuse or misuse the Application

Effect of Termination

Upon termination:

• Your license to use the Application ends

• You must uninstall all copies of the Application

• Local data and credentials remain on your device until you delete them

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• Updated Terms will be posted on our website

• The "Effective Date" will be updated

• Continued use after changes constitutes acceptance

For significant changes, we may provide notice through the Application or our website.

14. General Provisions

Governing Law

These Terms are governed by the laws of Turkey, without regard to conflict of law principles.

Dispute Resolution

Any disputes shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Turkey.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire Agreement

These Terms constitute the entire agreement between you and Llaps Digital regarding the Application, superseding any prior agreements.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

By using CloudOps, you acknowledge that:

1. You have read and understood these Terms of Service

2. You have read and understood our Privacy Policy

3. You are a software developer or authorized to use developer tools

4. You have legal authority to access the CloudKit containers you manage

5. You understand the capabilities and risks of bulk data operations

6. You are responsible for backing up important data

CloudOps is not affiliated with Apple Inc. CloudKit, macOS, iCloud, and Keychain are trademarks of Apple Inc.
