1. ACCEPTANCE OF TERMS
Welcome to Point of Feed ("the App"), developed and operated by Llaps Digital ("we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of the modified Terms.
2. DESCRIPTION OF SERVICE
Point of Feed is a news aggregation application that:
• Collects and displays headlines and summaries from publicly available RSS feeds from international news sources
• Allows users to generate AI-powered commentary on news articles using various Large Language Model (LLM) providers
• Enables users to save articles locally and customize their news feed preferences
• Provides customizable AI personas with different personality traits, communication styles, and perspectives
• Displays advertisements served by Google AdMob (Google LLC)
• Collects analytics and diagnostic data via Firebase and Mixpanel to improve App quality and performance
3. AGE REQUIREMENTS
You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
The App aggregates news content from various international sources, which may include coverage of mature topics such as politics, conflict, crime, and other world events. Parental discretion is advised.
4. USER ACCOUNTS AND REGISTRATION
Point of Feed does not require user registration or account creation. All preferences, saved articles, and settings are stored locally on your device. You are responsible for maintaining the security of your device and any API keys you choose to store within the App.
5. AI-GENERATED COMMENTARY
5.1 Nature of AI Commentary
The App allows you to generate commentary on news articles using AI language models. It is important to understand that:
• AI-generated commentary represents simulated perspectives and viewpoints, not factual analysis or journalism
• Commentary is generated by artificial intelligence and does not reflect the views of Llaps Digital, news publishers, or any real individuals
• AI personas are fictional constructs designed to demonstrate different analytical frameworks and communication styles
• The quality, accuracy, and nature of AI output depends on the LLM provider and model you select
5.2 Disclaimer of AI Content
AI-GENERATED COMMENTARY IS PROVIDED FOR ENTERTAINMENT AND ILLUSTRATIVE PURPOSES ONLY. IT DOES NOT CONSTITUTE:
• Professional journalism or factual reporting
• Legal, financial, medical, or professional advice of any kind
• Verified or fact-checked information
• Endorsement of any viewpoint, position, or course of action
• A substitute for your own research, judgment, or professional consultation
You should not rely on AI-generated commentary for making important decisions. Always consult qualified professionals for legal, financial, medical, or other professional matters.
LLAPS DIGITAL IS NOT LIABLE FOR ANY CONTENT GENERATED THROUGH THE APP. ALL GENERATED CONTENT IS SOLELY DEPENDENT ON AND DETERMINED BY THE AI PROVIDER AND MODEL YOU HAVE SELECTED. LLAPS DIGITAL ACTS SOLELY AS A CONDUIT BETWEEN YOU AND YOUR CHOSEN AI PROVIDER AND ASSUMES NO RESPONSIBILITY WHATSOEVER FOR THE NATURE, ACCURACY, OR CONSEQUENCES OF ANY OUTPUT PRODUCED.
5.3 LLM Provider Responsibility
When you generate AI commentary, you are using third-party LLM services (such as Anthropic Claude, OpenAI GPT, Google Gemini, OpenRouter, and others). The output you receive is determined by:
• The LLM provider and model you have selected
• The provider's content policies and safety filters
• The specific API configuration and capabilities of that provider
Each LLM provider has its own terms of service, content policies, and acceptable use guidelines. By using a particular provider through our App, you agree to comply with that provider's terms. Llaps Digital is not responsible for the content generated by third-party LLM providers.
If you use Apple Intelligence (where available), processing occurs entirely on your device under Apple's terms and policies.
5.4 Your Responsibilities
You agree not to use the AI commentary features to:
• Generate content that violates any applicable laws or regulations
• Create misleading content intended to deceive others about its source or nature
• Produce content that infringes on any third party's intellectual property rights
• Generate harmful, abusive, threatening, or harassing content
• Circumvent any safety measures or content policies of LLM providers
6. NEWS CONTENT AND THIRD-PARTY SOURCES
6.1 RSS Feed Content
The App displays headlines, summaries, and links from publicly available RSS feeds provided by third-party news organizations. This content:
• Remains the property of the respective publishers and copyright holders
• Is displayed as provided by the RSS feeds with proper attribution
• Is not modified, edited, or endorsed by Llaps Digital
• May be subject to the terms and conditions of the original publishers
6.2 Links to External Sites
When you tap to read a full article, you will be redirected to the original publisher's website. These third-party sites have their own terms of use and privacy policies. Llaps Digital is not responsible for the content, accuracy, or practices of external websites.
6.3 No Endorsement
The inclusion of any news source in the App does not constitute an endorsement of that source, its editorial positions, or its accuracy. The App provides access to diverse sources representing various perspectives, and users should exercise their own judgment in evaluating news content.
7. API KEYS AND THIRD-PARTY SERVICES
7.1 Your API Keys
To use AI commentary features with cloud-based LLM providers, you must provide your own API keys. You are responsible for:
• Obtaining API keys in compliance with each provider's terms of service
• Keeping your API keys secure and confidential
• Any charges incurred from your use of third-party APIs
• Complying with usage limits and acceptable use policies of each provider
7.2 Key Storage and Security
API keys are stored locally on your device using iOS Keychain, Apple's secure storage mechanism. Llaps Digital never transmits, collects, or has access to your API keys. If your device is compromised, your API keys may be at risk. We recommend using API keys with appropriate spending limits.
7.3 Google AdMob (Advertising)
The App integrates Google AdMob (Google LLC) to serve advertisements. By using the App, you acknowledge that:
• Google AdMob may collect device identifiers, approximate location, advertising data, and usage signals to serve and measure ads
• Ads may be personalized based on your device's advertising identifier (IDFA) subject to your iOS tracking preferences
• You can limit ad personalization via iOS Settings > Privacy & Security > Tracking > toggle off Point of Feed
• Ad content is determined by Google and not controlled by Llaps Digital
• Google AdMob is governed by Google's Privacy Policy: https://policies.google.com/privacy
7.4 Firebase (Crash Reporting & Performance)
The App integrates Firebase (Google LLC) for crash reporting and performance monitoring. Firebase may collect crash data, performance metrics, diagnostic data, and device identifiers. This data is used solely to identify bugs and improve App stability. Firebase operates under Google's Privacy Policy and Firebase's privacy terms: https://firebase.google.com/support/privacy
7.5 Mixpanel (Product Analytics)
The App integrates Mixpanel to understand how users interact with App features. Mixpanel may collect product interaction events, usage data, device identifiers, and session information. This data is used to improve App features and user experience. Mixpanel operates under its own Privacy Policy: https://mixpanel.com/legal/privacy-policy
By using the App, you agree to the data practices of these third-party SDKs as described in our Privacy Policy and in each provider's own policies.
8. IN-APP PURCHASES AND ADVERTISEMENTS
8.1 Free Features
The App offers the following free features:
• Full access to RSS news aggregation and reading
• One free custom AI persona
• One free AI commentary generation
• Saving and organizing articles
8.2 Ad-Supported Features
After your first free AI commentary generation, subsequent commentary generations require watching a short video advertisement served by Google AdMob. By engaging with these ads you acknowledge:
• Advertisements are served by Google AdMob and subject to Google's terms and policies
• Ads may be personalized or non-personalized depending on your iOS tracking preference settings
• Ad content is determined by Google and not controlled by Llaps Digital
• Llaps Digital is not responsible for the content of advertisements
To opt out of personalized advertising: iOS Settings > Privacy & Security > Tracking > toggle off Point of Feed.
8.3 Remove Ads Purchase
You may purchase "Remove Ads" for a one-time payment of $2.99 USD (or equivalent in your local currency). This purchase:
• Permanently removes all advertisements from the App
• Grants unlimited AI commentary generations without watching ads
• Is non-refundable except as required by applicable law or Apple's refund policies
• Is tied to your Apple ID and can be restored on other devices using the same Apple ID
Note: Purchasing "Remove Ads" removes in-App advertisements only. Firebase and Mixpanel analytics and diagnostics SDKs remain active regardless of this purchase, as they serve a separate purpose of improving App quality and stability.
8.4 Payment Processing
All purchases are processed through Apple's App Store. Apple's terms and conditions apply to all transactions. We do not have access to your payment information.
9. INTELLECTUAL PROPERTY
9.1 Our Intellectual Property
The App, including its design, code, features, and branding (excluding third-party content), is owned by Llaps Digital and protected by intellectual property laws. You may not:
• Copy, modify, or distribute the App or its components
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Use our trademarks without written permission
9.2 News Content Ownership
All news content displayed in the App remains the intellectual property of the respective publishers. The App's display of headlines and summaries from RSS feeds is pursuant to the terms under which those feeds are made publicly available.
9.3 AI-Generated Content
Ownership and licensing of AI-generated content may vary based on the LLM provider's terms of service. Please review your chosen provider's terms regarding ownership of AI outputs.
10. PROHIBITED USES
You agree not to:
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems (bots, scrapers) to access the App
• Redistribute or republish content from the App without authorization
• Use the App in any way that could damage our reputation or the reputation of news sources
• Misrepresent AI-generated commentary as human-written journalism or factual reporting
11. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
WE DO NOT WARRANT THAT:
• THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
• NEWS CONTENT OR AI COMMENTARY WILL BE ACCURATE, COMPLETE, OR CURRENT
• RSS FEEDS WILL REMAIN AVAILABLE OR FUNCTIONAL
• THIRD-PARTY LLM SERVICES WILL BE AVAILABLE OR PERFORM AS EXPECTED
• ADVERTISEMENTS SERVED BY GOOGLE ADMOB WILL BE APPROPRIATE FOR ALL USERS
• THIRD-PARTY SDKS (ADMOB, FIREBASE, MIXPANEL) WILL OPERATE WITHOUT INTERRUPTION OR ERROR
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LLAPS DIGITAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP
• DAMAGES RESULTING FROM ANY CONTENT OBTAINED FROM THE APP, INCLUDING NEWS CONTENT OR AI-GENERATED COMMENTARY
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR DATA OR API KEYS
• ANY CHARGES INCURRED FROM THIRD-PARTY API USAGE
• ANY ACTIONS OR DATA PRACTICES OF THIRD-PARTY SDKS INCLUDING GOOGLE ADMOB, FIREBASE, OR MIXPANEL
• DAMAGES RESULTING FROM ANY CONTENT OF ADVERTISEMENTS SERVED THROUGH THE APP
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $10.00, WHICHEVER IS GREATER.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Llaps Digital and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
• Your use of the App
• Your violation of these Terms
• Your violation of any rights of any third party
• Your use of third-party LLM services
• Any content you generate or share using the App
14. TERMINATION
We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including breach of these Terms.
You may terminate your use of the App at any time by deleting it from your device. Upon termination, all locally stored data will be deleted.
15. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
16. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Llaps Digital regarding your use of the App and supersede any prior agreements.
